Pre-nuptial agreements

When you are planning to marry the last thing on your mind is likely to be the possible future breakdown of the relationship. We all enter long term commitments like marriage in the hope and belief that the future will be rosy. Unfortunately as we all know that is not always the case and the existence of a professionally drafted legal agreement in those circumstances could be invaluable.

English divorce courts used to be reluctant to take account of agreements made by a couple prior to their marriage. However more recent cases indicate that the UK is catching up with the rest of the world where pre-nuptial agreements have been successfully used for many years.

By entering into a pre-nuptial agreement a couple can record their wishes in the hope of avoiding what can be lengthy, unpleasant and costly legal disputes over assets.

A pre-nuptial agreement can be of particular significance and value where the parties to a marriage have introduced unequal proportions of wealth into the relationship.

At Shacklocks we believe that any pre-nuptial agreement entered into must be fair and carefully drafted in order to meet legal requirements. However, by putting those arrangements in place you may both be sparing each other increased distress and uncertainty in the event that your marriage breaks down.
